Terms of Service
1. Agreement and Operator
These Terms of Service govern your use of the Pssly mobile application and related hosted pages. By accessing or using Pssly, you agree to these terms.
Pssly is operated from Australia. If you need to send a legal notice or request operator details, contact [email protected].
2. Eligibility and Accounts
- You must be at least 13 years old, or any higher minimum age required where you live.
- You must provide accurate account information and keep your sign-in credentials secure.
- You must not create accounts using false details, access someone else's account, or return after a valid ban without permission.
3. Acceptable Use
Pssly is intended for lawful social logging of Drops and participation in Territories. You must use it lawfully and respectfully.
- Do not post illegal, threatening, harassing, hateful, or sexually explicit content.
- Do not upload content that infringes privacy, publicity, copyright, or other rights.
- Do not use the app to spam, scrape, automate misuse, interfere with the service, or attempt unauthorised access.
- Do not use the app in places or ways that break local laws, trespass rules, or public decency rules.
4. User Content and Moderation
You keep ownership of the content you upload, but you grant Pssly a non-exclusive licence to host, store, reproduce, and display that content as needed to operate the service and show it according to your privacy settings.
Users can report content or accounts, and the app supports blocking. We may review reported content and may remove content, restrict accounts, or retain information where reasonably necessary for abuse review, security, legal compliance, or dispute handling.
These terms do not promise that every item is pre-screened or reviewed within a fixed time.
5. Privacy
Your use of Pssly is also governed by the Privacy Policy.
Pssly uses product analytics and error monitoring. Product analytics can be turned on or off in Settings > Privacy > Product Analytics, but crash and error telemetry may still be processed for security and stability.
6. Premium Features, Billing, and Refunds
- Premium subscriptions are billed and managed through Apple App Store or Google Play.
- You are responsible for cancelling through the relevant store to avoid future renewals.
- Purchase restoration is handled through the in-app restore purchases flow where supported by the platform providers.
- Refund requests are handled under Apple or Google rules and any rights you have under applicable law.
- If your account is restricted or terminated for misuse, access to premium features may end, but nothing in these terms limits any non-excludable rights you may have under law.
7. Suspension and Termination
We may suspend, restrict, or terminate access where reasonably necessary and as permitted by law, including for term breaches, safety issues, abuse, fraud, legal requests, security incidents, or material risk to the service or other users.
You may stop using the app at any time. You may also delete your account through the in-app settings, but deleting your account does not itself cancel an app store subscription.
8. Disclaimers and Australian Consumer Law
To the maximum extent permitted by law, Pssly is provided on an as-is and as-available basis and we do not promise uninterrupted availability, error-free operation, or that all content will be accurate or suitable for every purpose.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, statutory guarantee, or other right that cannot be excluded under Australian Consumer Law or other applicable law.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of goodwill, or loss of data arising from your use of Pssly.
Where liability cannot be excluded but can be limited, our liability is limited to the remedies available under applicable law.
10. Disputes and Governing Law
If you have a concern, contact [email protected] first so we can try to resolve it informally.
These terms are governed by the laws of Australia. Subject to any rights you have under applicable law, disputes that cannot be resolved informally will be handled by the courts of Australia.
11. Changes to These Terms
We may update these terms from time to time to reflect legal, security, operational, or feature changes. When changes are material, we will update the date above and may also provide an in-app notice or email where appropriate.
If you continue using Pssly after the updated terms take effect, you accept the updated terms.
